The ex-lawyer for the former president has stepped down as New Jersey's top federal prosecutor. This follows a court battle that invalidated her legal standing to occupy the role.

Acceptance of Resignation

US Attorney General, the Attorney General, confirmed Habba's resignation on Monday. In a statement that the court's "flawed" ruling made it impossible for the official to perform her duties.

"Let no one confuse compliance for surrender," she wrote. "This battle will now stretch across the country."

Legal Background

The departure was triggered by a judicial panel determined that she had been unlawfully serving as the top prosecutor. This decision is likely to affect scores of prosecutions in the Garden State.

The judicial panel ruled that a temporary posting that bypassed Senate approval violated the Federal Vacancies Reform Act.

The Attorney General added that she will remain at the justice department as a senior adviser. She will challenge the decision of the disqualification, in the hope of achieving a overturned decision.

In a statement, the Attorney General wrote that judges "must not countermand the appointment of lawyers tasked with carrying out the executive branch's core responsibility of prosecuting crime."

The attorney general highlighted the prosecutor's work and said that under her leadership, the city of Newark saw a significant drop in crime. She also stated that the southern city of Camden had its initial homicide-free summer since 1974 free from homicides.

Legal Career

The 41-year-old attorney, originally became part of Donald Trump's lawyers in 2021. Subsequently, she acted for her client in his New York criminal case in the previous year, when he was conviction on 34 counts of falsifying business records.

Prior to assuming the federal prosecutor position, the former president had revealed he was selecting her as his presidential counsellor if re-elected, labeling the lawyer as "unwavering in her loyalty" and a relentless legal advocate.
